ASM Lab Terms of Use and Licence Agreement

These terms are an agreement between you and ASM Lab ("we", "us") for the use of the ASM Lab software, its documentation, sample projects and updates (together, "ASM Lab"). By installing, activating or using ASM Lab you accept these terms. If you do not accept them, do not install or use ASM Lab.
1. What ASM Lab is for
ASM Lab is mine ventilation and thermal modelling software provided for academic research and evaluation. It is free of charge for that purpose.
2. Your licence
We give you a personal, non-exclusive, non-transferable and revocable licence to install and use ASM Lab with a valid licence key, on no more computers than that key allows, for academic and evaluation purposes.
3. What you may not do
You may not, and may not let anyone else:
- share, publish, sell or transfer a licence key beyond the computers it allows;
- get around, disable or interfere with the licence checks;
- copy, modify, translate or make works based on ASM Lab, except your own project files;
- decompile, disassemble or reverse engineer ASM Lab, except as far as the law allows despite this restriction;
- rent, lend, sell or sublicense ASM Lab, or offer it as a service;
- remove copyright or other notices from ASM Lab;
- use ASM Lab for anything unlawful.
4. Licence checks and internet connection
ASM Lab checks its licence key online when activated and at least once a day (see the Privacy Policy). A licence can have an expiry date, and we may change the number of computers it allows, move it to another computer at your request, or withdraw it, for example when the academic or evaluation programme ends. Without a valid licence ASM Lab will not open your work; your project files stay on your computer and remain yours.
5. Engineering results: important
ASM Lab produces estimates from the information you enter and from simplified models of airflow, fans, heat and humidity. Results can be wrong, for example because of incorrect inputs, model limits or software faults.
- ASM Lab is not a substitute for the judgement of a competent, qualified mine ventilation engineer.
- Every result used to design, operate or make decisions about a mine must be checked by such a person before it is relied on.
- Do not rely on ASM Lab alone for decisions affecting the health or safety of people. Complying with the Mine Health and Safety Act, 1996, its regulations and any other law remains your responsibility and your employer's.
6. Your projects and feedback
Your project files belong to you; we claim no rights in them. If you send a bug report, suggestion or other feedback, we may use it to improve ASM Lab without any obligation to you.
7. Updates
We may release updates that fix problems, change features or change these terms. The installed app tells you about updates and installs them when you agree. Older versions may stop being supported.
8. No warranty
ASM Lab is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and freedom from errors, to the fullest extent the law allows.
9. Limitation of liability
To the fullest extent the law allows, ASM Lab and its contributors are not liable for any loss or damage arising from the use of, or the inability to use, ASM Lab or its results, including loss of data, profit, production or business, or indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including any right you have under the Consumer Protection Act, 2008, where it applies.
10. Ending the licence
Your licence ends when your licence key expires or is withdrawn, or automatically if you break these terms. When it ends you must stop using ASM Lab. Sections 5, 6, 8, 9, 11 and 12 continue to apply.
11. Third-party software
ASM Lab includes open-source components, each under its own licence, which take precedence for those components. They are listed in the Copyright notice and the "Third-party notices" shipped with ASM Lab.
12. Governing law
These terms are governed by the law of the Republic of South Africa, and the courts of South Africa have jurisdiction.
13. Changes to these terms
We may change these terms. The version and date at the top change when we do, and ASM Lab asks you to accept the new version before you continue using it.
